  5.   ChessTiger.com Software License and Limited Warranty

  7.   This legal document is an agreement between you, THE LICENSEE,
  8.   and ChessTiger.com, THE LICENSOR.
  9.   By executing the program files, you agree to be bound by the terms
  10.   of this agreement, which includes the Software License, Limited
  11.   Warranty and Acknowledgment. If you do not agree to the terms
  12.   presented in this agreement, DO NOT OPEN the program files.
  13.   In order to protect our rights, ChessTiger.com does not SELL any
  14.   rights to software. Rather ChessTiger.com grants the right to Use
  15.   the software by means of a SOFTWARE LICENSE.
  16.   ChessTiger.com specifically retains the title to all ChessTiger.com
  17.   computer software.

  19.   SOFTWARE LICENSE

  21.   1. Grant of a License. In consideration of payment of The LICENSE
  22.   FEE (part of the price you paid for this product), and your
  23.   agreement to abide by the terms and conditions of this License
  24.   and the Limited Warranty, ChessTiger.com THE LICENSOR,
  25.   grants you, THE LICENSEE, a non-exclusive right to use this copy of
  26.   the ChessTiger.com software program named "Chess Tiger for Palm"
  27.   (herein called the "Software") on the number of computers (i.e.
  28.   CPU's) specified in the heading of this License so long as you
  29.   comply with the terms of this License.

  31.   2. Ownership of Software. As a Licensee, you own the physical
  32.   media on which the software is originally or subsequently
  33.   recorded, but an express condition of this License is that
  34.   ChessTiger.com retains title and ownership of the Software recorded
  35.   on the original disk(s) and all subsequent copies of the Software,
  36.   regardless of the form or media in or on which the original and
  37.   other copies may exist. This License is NOT a sale of the original
  38.   Software or any copy.

  40.   3. Copying Restrictions. This software and the accompanying written
  41.   materials are the subject of copyright. Unauthorized copying of the
  42.   software, including Software that has been modified, or of the
  43.   written materials is expressly forbidden. You may be held legally
  44.   responsible for any copyright infringement which has been
  45.   encouraged or caused by the failure to abide by the terms of this
  46.   License.

  48.   4. Use Restrictions. As the Licensee, you may physically transfer
  49.   the Software from one computer to another provided that the
  50.   Software is used on only the number of computers specified in the
  51.   heading of this License at any one time. You may not distribute
  52.   copies of the Software or accompanying written materials to others.
  53.   You may not modify, adapt, translate, reverse engineer,
  54.   disassemble, decompile, or create derivative works based on the
  55.   Software. You may not modify, adapt, translate, reverse engineer,
  56.   disassemble, decompile, or create derivative works based on the
  57.   written materials without the prior written consent of
  58.   ChessTiger.com

  60.   5. Other Limitations

  62.   Limitations on Reverse Engineering, Decompilation, and Disassembly.
  63.   You may not reverse engineer, decompile, or disassemble the
  64.   SOFTWARE, except and only to the extent that such activity is
  65.   expressly permitted by applicable law notwithstanding this
  66.   limitation.

  68.   Separation of Components. The SOFTWARE is licensed as a single
  69.   product. Its component parts may not be separated for use on more
  70.   than one computer.

  72.   Rental or Lease. You may not rent or lease the SOFTWARE.

  74.   Software Transfer. You may permanently transfer all your rights
  75.   under this License, provided you retain no copies; you transfer
  76.   all of the SOFTWARE, including all component parts, the media, any
  77.   upgrades and this License; and the recipient agrees to the terms of
  78.   this License.

  80.   6. Termination. Without prejudice to any other rights,
  81.   ChessTiger.com may terminate this License if you fail to comply
  82.   with the terms and conditions of this License. In such event, you
  83.   must destroy all copies of the SOFTWARE and all of its component
  84.   parts.

  86.   7. Miscellaneous. This License shall be governed and construed
  87.   in accordance with the laws of France and shall benefit
  88.   ChessTiger.com, its successors and assigns.

  90.   LIMITED WARRANTY AND DISCLAIMER OF WARRANTY

  92.   The software and accompanying written material (including
  93.   instructions for use) are provided "as is" without warranty of
  94.   any kind. Further, ChessTiger.com does not warrant, guarantee or
  95.   make any representations regarding the use or the results of use,
  96.   of the Software or written materials in terms of correctness,
  97.   reliability, accuracy or fitness for purpose. The entire risk as to
  98.   the results and performance of the software is assumed by you.
  99.   Should the software be defective, you and not ChessTiger.com or its
  100.   dealers, agents, distributors or employees, assume the entire cost
  101.   of all necessary repair, servicing and correction.

  103.   The above is the only warranty of any kind, either express or
  104.   implied, including but not limited to the warranties of
  105.   merchantability and fitness for purpose, that ChessTiger.com makes
  106.   regarding this product. No oral or written information or advice
  107.   given by ChessTiger.com or its dealers, agents, distributors or
  108.   employees shall create a warranty or in any way increase the scope
  109.   of this warranty.

  111.   Neither ChessTiger.com nor anyone else who has been involved in the
  112.   creation, production or delivery of this product shall be liable
  113.   for any direct, indirect, consequential or incidental damages
  114.   (including damages for loss of business profits, business
  115.   interruption, loss of business information, and the like.) arising
  116.   out of the use or inability to use this product even if
  117.   ChessTiger.com has been advised of the possibility of such damages.

  119.   This does not affect your statutory rights.

  121.   This Limited Warranty shall be governed and construed in accordance
  122.   with the laws of France.

  124.   ACKNOWLEDGMENT

  126.   You acknowledge that you have read this License and Limited
  127.   Warranty, understand them, and agree to be bound by their terms and
  128.   conditions.
